Working to Minimize or Avoid Harsh Penalties for Texas Assault and Sexual Assault Crimes
Assault and sexual assault can result in misdemeanor or felony charges, depending on the type of conduct, prior offenses, resulting injuries and various other factors. I have proven experience defending clients facing all types of assault charges from simple assault to felony sexual assault.
- Simple assault/Class C misdemeanor assault: Simple assault can involve any form of unwanted contact, from touching or slapping to pushing or shoving. A conviction can result in steep fines.
- Class A assault (misdemeanor assault): Class A misdemeanor assault can involve any abuse or assault that results in visible injuries (including something as trivial as a scratch) or nonvisible injuries (such as pain). Family violence also constitutes a Class A assault. A misdemeanor assault conviction can result in a jail term of up to one year as well as other serious consequences.
- Felony assault and sexual assault: If the alleged offense is sexual in nature (sexual assault), results in serious bodily injury or involves the use of a weapon, it can be charged as felony assault. Additionally, repeat family violence offenses and assault offenses against an elderly person, teacher or police officer can also be charged as felony assault. Depending on the circumstances, conviction for felony assault can result in a jail term of 180 days up to life imprisonment.
- Sexual assault: Sexual assault charges can vary significantly from charges involving exposure or statutory rape (even if it is "consensual") to felony sexual assault charges involving sex with a minor child, or repeat sexual offenses, which can have grave consequences. Many times these incidents arise from false allegations during custody battles to gain leverage. Any sexual assault case is serious, however, and requires experienced and tactical defense.
A meaningless bar fight, disagreement with a neighbor or dispute with a family member can quickly build until the point that the police are called or someone is hurt. Once the police are called to the scene, someone will usually be arrested and the prosecutor will proceed with filing assault charges. When the potential stakes are so high, it is important to have an experienced lawyer on your side who is dedicated to helping you build and present the strongest defense strategy possible. I know how to effectively investigate assault cases and I will work hard to obtain a favorable result, whether that means negotiating for a reduction in charges (to a nondeportable, nonfamily misdemeanor offense, for example) or it means presenting your case effectively at trial. Having handled more than 70 criminal trials in my career as a criminal defense lawyer and former prosecutor, I am equipped to represent your interests before a jury.
